Please read these terms carefully before downloading or using Hugo. By downloading, installing, or using Hugo, you agree to be bound by these terms. If you do not agree, do not use the app.

1. Who we are

Hugo is operated by Hugo App Ltd, a company incorporated in England and Wales (Company Number: 17036487), with its registered office at 10 Dryden Court, St Neots, PE19 1QY, United Kingdom. References to "Hugo", "we", "us", or "our" in these terms refer to Hugo App Ltd.

2. The service

Hugo is a macOS focus and productivity application that helps you manage your attention during timed work sessions. It works by hiding non-allowed applications, controlling browser tabs in Chrome and Safari, and using AI to evaluate whether newly opened tabs are relevant to your stated focus goal.

Hugo is available on macOS 13 and above. A companion Chrome extension, Hugo Bridge, is required for Chrome tab enforcement. Hugo is not available on Windows, iOS, Android, or any other platform at this time.

3. Eligibility

You must be at least 13 years old to use Hugo, or at least 16 years old if you are in a jurisdiction where GDPR applies. By using Hugo, you confirm that you meet the applicable age requirement and that you have the legal capacity to enter into a binding agreement.

4. Your account and licence

Hugo does not require you to create an account to use the free tier. When you subscribe to Hugo Pro, your email address is used to identify your subscription via Stripe. You are responsible for keeping your email address up to date.

Your licence to use Hugo is personal and non-transferable. You may not share your subscription with other people or use it on more than one device at a time. Hugo uses a device identifier to enforce this. If we detect licence sharing, we reserve the right to suspend or terminate your access.

5. Free tier

The free tier of Hugo gives you access to core session functionality at no charge, with the following limits:

• Maximum session duration of 45 minutes
• Maximum of 2 sessions per day
• 3 free Hugo AI trial sessions (one-time, not recurring)
• Deep Work and Break session types only

The free tier is available indefinitely. We reserve the right to change the limits of the free tier with reasonable notice.

6. Hugo Pro subscription

What is included

Hugo Pro gives you unlimited sessions, unlimited session duration (up to 120 minutes per session), access to all session types including Pomodoro Mode, Research Mode, and Hugo AI, as well as Insights, Weekly Reviews, Milestones, Projects, and all future Pro features.

Pricing

• Monthly plan: $12.00 per month
• Annual plan: $99.00 per year

All prices are in US dollars and are exclusive of any applicable taxes. We reserve the right to change pricing with at least 30 days notice to existing subscribers.

Free trial

We may offer a time-limited free trial of Hugo Pro at our discretion. Trial terms will be displayed at the time of sign-up. At the end of the trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

Billing and payment

Payments are processed by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring basis at the applicable billing interval. Hugo never sees or stores your payment card details. You can update your payment method or cancel your subscription at any time via the Stripe customer portal.

Cancellation and refunds

You may cancel your Hugo Pro subscription at any time. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial billing periods except where required by applicable law. If you are based in the UK or EU, you have the right to cancel within 14 days of your first purchase under the Consumer Contracts Regulations 2013 and equivalent EU legislation, unless you have already begun using the Pro features, in which case your right to a full refund may be affected.

7. Hugo AI

Hugo AI is a feature that uses Google Gemini to automatically evaluate whether browser tabs you open during a session are relevant to your stated focus goal. Before your first Hugo AI session, you will be shown a consent modal that explains what data is sent to Google Gemini. You must actively consent before the feature activates.

Hugo AI decisions are automated and may occasionally be incorrect. You can override any AI decision with a single tap. Hugo is not responsible for decisions made by Hugo AI, including tabs that are blocked or allowed in error.

Free users receive 3 Hugo AI trial sessions. After those are used, Hugo AI requires a Pro subscription.

8. Acceptable use

You agree not to:

• Reverse engineer, decompile, or disassemble Hugo or Hugo Bridge
• Attempt to bypass, circumvent, or disable Hugo's licence verification or enforcement mechanisms
• Use Hugo in any way that violates applicable law or regulation
• Share your subscription credentials or device licence with others
• Interfere with or disrupt Hugo's backend infrastructure
• Use Hugo to monitor or control another person's device without their knowledge and consent

9. Intellectual property

Hugo, Hugo Bridge, the Hugo backend, and all associated trademarks, logos, and content are the property of Hugo App Ltd. All rights are reserved. These terms do not grant you any ownership rights in Hugo. You are granted a limited, non-exclusive, non-transferable licence to use Hugo for personal productivity purposes in accordance with these terms.

10. Disclaimer of warranties

Hugo is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that Hugo will be uninterrupted, error-free, or free of bugs. We do not guarantee any particular productivity outcome from using Hugo.

To the fullest extent permitted by applicable law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, Hugo App Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of Hugo, including but not limited to loss of data, loss of productivity, missed deadlines, or any harm caused by a tab being closed, blocked, or allowed by Hugo or Hugo AI.

Our total aggregate liability to you in connection with these terms shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim, or £100, whichever is greater.

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

12. Consumer rights (UK and EU users)

If you are a consumer based in the UK or EU, nothing in these terms affects your statutory rights. The Consumer Rights Act 2015 (UK) and equivalent EU consumer protection laws apply to your use of Hugo where relevant.

13. Changes to Hugo and these terms

Hugo is in active development. We may add, modify, or remove features at any time. We will give reasonable notice of changes that materially affect paid subscribers, particularly those on annual plans.

We may update these terms from time to time. We will notify you of material changes via the app or by email. Continued use of Hugo after changes take effect constitutes acceptance of the updated terms.

14. Termination

You may stop using Hugo at any time. We may suspend or terminate your access if you breach these terms, with or without notice depending on the severity of the breach. Upon termination, your licence to use Hugo ends immediately. Sections 9, 10, 11, and 15 survive termination.

15. Governing law and disputes

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of Hugo shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where you are a consumer in the EU or another jurisdiction that grants you the right to bring proceedings in your local courts.

If you are based in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
