Please read these terms carefully before downloading or using Hugo. By downloading, installing, or using Hugo, you agree to be bound by these terms. If you do not agree, do not use the app.

1. Who we are

Hugo is operated by Hugo App Ltd, a company incorporated in England and Wales (Company Number: 17036487), with its registered office at 10 Dryden Court, St Neots, PE19 1QY, United Kingdom. References to "Hugo", "we", "us", or "our" in these terms refer to Hugo App Ltd.

2. The service

Hugo is a macOS focus and productivity application that helps you manage your attention during timed work sessions. It works by hiding non-allowed applications, controlling browser tabs in Chrome and Safari, and using AI to evaluate whether newly opened tabs are relevant to your stated focus goal.

Hugo is available on macOS 14 and above. A companion Chrome extension, Hugo Bridge, is required for Chrome tab enforcement. Hugo is not available on Windows, iOS, Android, or any other platform at this time.

3. Eligibility

You must be at least 13 years old to use Hugo, or at least 16 years old if you are in a jurisdiction where GDPR applies. By using Hugo, you confirm that you meet the applicable age requirement and that you have the legal capacity to enter into a binding agreement.

4. Your account and licence

Hugo does not require you to create an account. To start your free trial, you need to give us an email address, which we keep with your trial and use to send you emails about it. When you subscribe to Hugo Pro, your email address is used to identify your subscription via Stripe. You are responsible for keeping your email address up to date.

Your licence to use Hugo is personal and non-transferable. You may not share your subscription with other people or use it on more than one device at a time. If we detect licence sharing, we reserve the right to suspend or terminate your access.

5. Free trial

Hugo comes with a free trial, so you can use every feature before you decide to pay. The free trial works as follows:

• It lasts 14 days from the moment it starts
• It includes everything in Hugo Pro (see section 6)
• You start it in the app with your email address, and no payment card is needed
• It is tied to your Mac, so deleting and reinstalling Hugo does not start a new trial
• It does not turn into a paid subscription, and you are not charged when it ends

Apart from the short guided session when you first set up Hugo, you need an active free trial or a Hugo Pro subscription to start a session. When your free trial ends, you will not be able to start sessions until you subscribe, but your insights, history and streaks stay available to view.

We reserve the right to change the terms of the free trial with reasonable notice.

6. Hugo Pro subscription

What is included

Hugo Pro gives you unlimited sessions of up to 120 minutes each, access to all session types including Pomodoro Mode, Research Mode, and Hugo AI, as well as Insights, Weekly Reviews, Milestones, Projects, and all future Pro features.

Pricing

• Monthly plan: $12.00 per month
• Annual plan: $99.00 per year

All prices are in US dollars and are exclusive of any applicable taxes. We reserve the right to change pricing with at least 30 days notice to existing subscribers.

Free trials and your first payment

If you subscribe during the free trial described in section 5, your subscription starts straight away and your first payment is taken at once. Any days left in your free trial do not carry over, and your billing period starts on the day you subscribe.

We may also offer a time-limited free trial of Hugo Pro when you subscribe through Stripe checkout, for example to users of older versions of Hugo. Trial terms will be displayed at the time of sign-up. At the end of that trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

Billing and payment

Payments are processed by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring basis at the applicable billing interval. Hugo never sees or stores your payment card details. You can update your payment method or cancel your subscription at any time via the Stripe customer portal.

Your subscription renews automatically each month or each year, depending on your plan, until you cancel it. While your subscription is active, you can open the Stripe customer portal from the Account section of Hugo's Settings. If a payment fails, you may not be able to start sessions until the payment goes through.

Cancellation and refunds

You may cancel your Hugo Pro subscription at any time. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial billing periods except where required by applicable law. If you are based in the UK or EU, you have the right to cancel within 14 days of your first purchase under the Consumer Contracts Regulations 2013 and equivalent EU legislation, unless you have already begun using the Pro features, in which case your right to a full refund may be affected.

7. Hugo AI

Hugo AI is a session mode that uses Google Gemini to judge, during a session, whether the browser tabs and pages you open, the windows you switch to in apps you allowed, and any hidden app you ask to open are relevant to your stated focus goal. For each check, Hugo sends your goal and details such as the web address, the title, a short extract of the page's text and any reason you type, through Hugo's backend to Google Gemini. With screen reading on, Hugo may also read the text on the window in front of you, on your Mac, and send some of that text; the picture itself never leaves your Mac. The short session during Hugo's onboarding uses Hugo AI, including when you replay onboarding from Settings. After onboarding, you can avoid Hugo AI by choosing another mode, such as Deep Work, Research or Break, before you start a session. You can turn screen reading off in Settings between sessions. Our Privacy Policy explains what is sent in more detail.

Hugo AI decisions are automated and may occasionally be incorrect. You can override any AI decision, although Hugo may first ask you to explain why you need the tab. Hugo is not responsible for decisions made by Hugo AI, including tabs that are blocked or allowed in error.

Hugo AI is included in your free trial and in Hugo Pro.

8. Acceptable use

You agree not to:

• Reverse engineer, decompile, or disassemble Hugo or Hugo Bridge
• Attempt to bypass, circumvent, or disable Hugo's licence verification or enforcement mechanisms
• Use Hugo in any way that violates applicable law or regulation
• Share your subscription credentials or device licence with others
• Interfere with or disrupt Hugo's backend infrastructure
• Use Hugo to monitor or control another person's device without their knowledge and consent

9. Intellectual property

Hugo, Hugo Bridge, the Hugo backend, and all associated trademarks, logos, and content are the property of Hugo App Ltd. All rights are reserved. These terms do not grant you any ownership rights in Hugo. You are granted a limited, non-exclusive, non-transferable licence to use Hugo for personal productivity purposes in accordance with these terms.

10. Disclaimer of warranties

Hugo is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that Hugo will be uninterrupted, error-free, or free of bugs. We do not guarantee any particular productivity outcome from using Hugo.

To the fullest extent permitted by applicable law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, Hugo App Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of Hugo, including but not limited to loss of data, loss of productivity, missed deadlines, or any harm caused by a tab being closed, blocked, or allowed by Hugo or Hugo AI.

Our total aggregate liability to you in connection with these terms shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim, or £100, whichever is greater.

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

12. Consumer rights (UK and EU users)

If you are a consumer based in the UK or EU, nothing in these terms affects your statutory rights. The Consumer Rights Act 2015 (UK) and equivalent EU consumer protection laws apply to your use of Hugo where relevant.

13. Changes to Hugo and these terms

Hugo is in active development. We may add, modify, or remove features at any time. We will give reasonable notice of changes that materially affect paid subscribers, particularly those on annual plans.

We may update these terms from time to time. We will notify you of material changes via the app or by email. Continued use of Hugo after changes take effect constitutes acceptance of the updated terms.

14. Termination

You may stop using Hugo at any time. We may suspend or terminate your access if you breach these terms, with or without notice depending on the severity of the breach. Upon termination, your licence to use Hugo ends immediately. Sections 9, 10, 11, and 15 survive termination.

15. Governing law and disputes

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of Hugo shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where you are a consumer in the EU or another jurisdiction that grants you the right to bring proceedings in your local courts.

If you are based in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
